Ashlee Simpson and Pete Wentz are about to begin a custody battle for the couple’s two years old son, Bronx Mowgli.
According to a new TMZ report, Pete Wentz does not agree with Ashlee obtaining the primary physical custody of the child, as the singer requested in the divorce papers. So, this separation can turn into an ugly custody battle as reports claim that Wentz is determined to take the case to court. And it seems that he has already filed the papers.
In the legal papers filed by Pete Wentz, as an answer to Ashlee’s own divorce petition, he asks joint physical and legal custody of the child, asking at the same time for both parties to pay their own legal fees. The documents were filed in Los Angeles County Superior Court. But, compared to the divorce papers filed by Ashlee, Pete also decided to reveal the date of the separation. So, the papers listed February 9 as the split date. The divorce reason cited by the couple was “irreconcilable difference.”
So, it seems that the two want different things when it comes to the custody of their two years old son. And while Ashlee is seeking for primary custody, with her soon former husband being grated only visitation rights, Pete wants joint legal and physical custody of the child. In her divorce papers, Ashlee Simpson also asked for spousal support, thing that hasn’t been mentioned in any way by Pete in the papers he recently filed in court. The star wants at the same time her name to be returned to Ashlee Nicole Simpson.
Pete Wentz is well known being the member of Fall Out Boy. He and his famous actress and singer wife wed in 2008. Pete Wentz and Ashlee Simpson opted for a private ceremony that was actually held at the Simpson family home in Encino, California, in front of close friends and family. The 31 years old musician filed the divorce papers on Tuesday. His wife did the same last month, the 26 years old singer releasing that time a statement to announce the separation, statement in which the couple claimed the split was amicable and that they remained committed and loving parents to their young son. The couple also claimed that Bronx remains their “No. 1 priority.” At the time of the marriage, Ashlee was already three months pregnant.
Well, if there will be a custody battle or not, we are about to see, but until now no other comments have been made by the two parties. However, the news about their separation came as a shock, as Pete Wentz and Ashlee Simpson definitely seemed like a happy couple. Still, reports claimed that the reason why the couple separated was given by the time spent apart, as Pete is constantly on tour. Reports also indicated that the couple has no prenuptial agreement.
