Lindsay Lohan is back in court. The troubled actress has been accused of stealing a $2,500 necklace from a jewelry store.
The star is expected to make her court appearance on Wednesday and she has already pleaded not guilty to the charges involving felony grand theft. However, reports indicate that there is a possibility for Lindsay to reach a plea deal and avoid jail or more complications to the case, although the chances for that to happen are very low. However, the star claimed to be innocent, as she said that she did not steal the $2,500 necklace from a Venice, California, jewelry store, but she borrowed it, having the permission to do so.
Anyway, it seems that this time it will be really hard for Lindsay to actually avoid being sent back to jail, mostly because Lindsay already is on probation. The probation is of course linked to Lindsay’s arrest that took place in 2007 when the star was convicted for driving under the influence of alcohol. Anyway, according to the Los Angeles Times, things can get quite serious this time and it seems that there are very few chances for Lindsay to manage to avoid jail if convicted on felony grand theft charges, as according Dmitry Gorin, a veteran former prosecutor, the district attorney could face serious accusations of giving the actress special treatment. And if the 24 years old star will be after all convicted, she can face up to three years in jail.
However, during the Wednesday hearing the judge will have to establish if the case can be solved without a trial, or Lindsay will after all have to face a jury. Anyway, it was previously reported that Lindsay’s lawyer said the actress is willing to accept a plea deal, under good term. And in fact it has been said that all Lindsay wants is to avoid jail.
But, Lindsay will have to be in court two times this week, as the star, besides the hearing for the grand theft charges, also has scheduled her progress hearing linked to the probation, for the end of this month. Meanwhile, there is another case investigated in which the star is involved. Lindsay has been accused of assaulting a Betty Ford facility center employee, after refusing to submit to an alcohol test. The actress may face battery charges, but it seems that prosecutors haven’t decided yet if the charges against Lindsay will be filed after all. The incident took place in December within the facility center where Lindsay Lohan was under rehab treatment. The star spent three months in rehab and was released on January 3.
On the other hand, Lindsay may avoid jail in this case, but it is hard to believe that the star won’t be sentenced to prison when it comes to her violating her probation, as reports already indicated that Los Angeles Superior Court Judge Keith Schwartz thinks Lindsay violated the supervised release and he has already warned the star that she will return to jail if she can not stay away of more legal problems. Anyway, according to a TMZ report, the judge thinks Lindsay should be sent to jail. Lindsay Lohan has already been both in jail and rehab for violating her probation. However, this time, Lindsay’s lawyer said that the actress did nothing to violate her probation, so she believes she is completely innocent.11
